This helps the officers monitor the activities of the offender more effectively. The offenders are usually required to adhere to a strict schedule of activities. Under the home confinement, there are two main types of programs. First, there are the pretrial programs which use home confinement as an alternative form of detention before the individuals are taken to court. Secondly, there are post-adjudication programs which use home confinement as an alternative to incarceration. This program was initially intended to serve as an alternative to sentencing for drunken driving offenders but has expanded to include other offenders as well. Generally, home confinement mainly excludes offenders of serious and violent crimes. The level of supervision or restriction is given depends on the type of the offender. These restrictions may be simple curfews or may be as severe as lock-downs. There are three main levels of restrictions: curfews, home detention, and home incarceration. When it comes to curfews, the participants of this program are required to be at home every day at specific times. Home detention requires that the participant remains in his home throughout except for specific approved times. Finally, home incarceration is when the offender is put under complete lock-down, except for specific activities approved by the court. Home confinement may be used by the courts as a sanction for people who go against the regulations of their supervision. The purpose o f home confinement depends on the stage of the criminal justice process in which it is applied. Regardless of the stage, however, it is mainly used as a means of protecting the public.

Juvenile Justice System Process - Essay Example During the decision making stage, where the arresting officer is still trying to make contact with the parents or making transfer arrangements, federal regulations require that the juvenile being held at adult penitentiaries be kept away from adult inmates (Neubauer & Fradelia, 2009). The law also stipulates that they should be removed from the adult facilities within six hours of arrest. The third stage is the transfer of the case to the juvenile probation department. Here the intake officer will then make a decision whether to dismiss the case, handle it informally or he may propose a formal hearing. Most of the Juvenile cases about 50 percent of them are dismissed (Neubauer & Fradelia, 2009). The probation officer has to review all the facts about the case during this stage and determine whether there is sufficient information to try the youth. If there is adequate evidence the case may be heard informally or formally depending on the available facts otherwise the case is dropped. While awaiting trial the juvenile is required by law to be detained in a secure facility. A judge often decides if the juvenile should be detained before and during the course of the trial. The officer also explains the intent of the detention in a detention hearing that takes place within 24 hours of arrest (Martin, 2005). The fourth stage is either informal, formal hearing or disposition. An informal hearing will be granted by a judge if the juvenile pleads guilty and agrees to settle the charges brought against him through acceptance to meet the courts requirements which may be: restitution, mandatory curfew, school attendance or rehabilitation (NCJRS, 2000). The juvenile is then released but will be monitored by a probation officer. In formal hearings a decision is made where the case will be heard and this may be in a juvenile or criminal court. Most of the cases will be heard in a juvenile court but egregious offenses will be tried in criminal courts (Neubauer & Fradelia, 200 9). Recommendations The juvenile system process varies within states but the above mentioned process is a standard procedure that is supposed to be followed. The problem is that the process is rarely followed. I would recommend that all states adopt the same process so that it becomes uniform. Secondly some states detain juveniles for over six hours in adult penitentiaries. This should stop because the minors go through a rough time in the cells and this affects them psychologically. The recognition of the fundamental right of the employees to form a union is in line with the basic human rights and the freedom of association and expressions, which no individual should be denied (Emerson, 2009). Therefore, through training the supervisors on the need to recognize and consequently respect the rights and freedoms of the employees to form and engage in union activities, the supervisors will cease to interfere with such freedoms of the employees, which will in turn serve to reduce the negative effects that the organization has felt, such as strikes and demonstrations. Additionally, by allowing the employees to engage in the formation of their own unions, they will be in a position to present their grievances to the employers or the relevant government agencies, which will, in turn, reduce the legal suits filed by the employees to the courts, which are detrimental to the organization, both in damaging its reputation, as well as causing it huge financial burdens (Dannin, 2006). The other fundamental aspect of the training for the supervisors, regarding the employee rights and freedoms, is the right of the employees to join and engage in the activities of a workersââ¬â¢ union, even if it is not recognized by the employer (Sack, 2010).
